What are the documents required to form an llc in Usa?

After the company is formed, you will need to open a bank account. At this stage, you may be asked for the following document or documents.

  1. ID or Passport
  2. A recent invoice proving your residence address (Digital banks do not require it, physical banks may request it)
  3. Company formment document (Articles of organization)
  4. Company's EIN number, Employer Identification Number (Cp575 or 147C)

In the first stage, you do not need any documents to form an llc. The main document requirements arise after the company is formed in the USA and when opening a bank account.

The person who will form an llc in the USA must be over 18 years old because the company owner will be asked for an identity document when opening a digital or physical bank account.

In order to form an llc in Usa, you will not be asked for any documents at the first stage. In fact, states do not even require an identity document from company owners, but in order for the company to do business, some documents are required to open a bank account after company formment. In addition, an ID or passport is required after installation to obtain some additional services and to obtain some company documents (Certified copy, Apostille, etc.).

For an LLC company formed in the USA by receiving service through a Registered Agent, no documents, including identification, are required in the first stage.

Is it possible for my name to be included in the documents of my company in Usa?

Unfortunately, it is not possible to add the identity document of the company owner to the company formation documents. Because anonymity is essential in companies formed in Usa, and in some states, even the name of the company owner is not recorded in any records. However, if this is important to you and you want your identity documents to appear in company documents, there is a different way.

Then, add the photo of your ID document to the last page of the contract and digitally convert the document back to PDF.

In this way, your notarized business contract, including your ID, and wet signed documents from the state will be ready. As a result, no documents are needed when forming an LLC company in the first stage. However, after the company is formed, you will need an ID to open accounts such as bank accounts or Stripe.

Why Is No ID Required When Forming an LLC in Usa?

In fact, there is no such practice in company formments in the USA, no state requires ID. Even if you insist on providing ID during company setup, the Registered Agent will not accept it because there are no US states where ID is required.

Some intermediary institutions may ask you for documents such as passport, residence and ID during company formment. In fact, they do not need these at the first stage, but they may request these documents at the beginning of the job in order not to ask for these documents from you or to ensure themselves and not to lose their connection with you.

In order to avoid the hassle of explaining to you the fact that there is no need for an ID during the company formment process in the USA, some intermediaries request an ID at the very beginning. Since this situation generally seems unreasonable to people when compared to the system of forming an llc in Turkey, they may first ask for an ID or passport instead of making an explanation.

LLC companies formed in some states such as Wyoming and New Mexico support the anonymous structure, so the name of the company owner may not be included in the company documents. Registered Agent information appears on these documents. In this case, you can show your name on the operating agreement and EIN document to prove whether the company belongs to you (there is no need for this).
